Asylum and Withholding of Removal

Asylum is a form of legal protection available to individuals who have either suffered past persecution or have a well-founded fear of future persecution. If granted, asylum allows you to remain in the U.S., obtain work authorization, and eventually apply for a Green Card after one year. If you are not yet in removal proceedings, you may apply for asylum affirmatively with U.S. Citizenship and Immigration Services (USCIS). If you are already in removal proceedings before an immigration judge, you may apply for asylum defensively with the Executive Office of Immigration Review (EOIR).

To be eligible, you must: 

Apply within one year of your arrival in the U.S. (with some exceptions);

 Prove that you have suffered persecution or have a well-founded fear of persecution;

Demonstrate, through your testimony and corroborating evidence, that the persecution is due to your race, religion, nationality, political opinion, or membership in a particular social group.

Withholding of Removal

If you do not qualify for asylum but still fear persecution in your home country, withholding of removal may be an option. This form of relief prevents deportation but does not provide a path to permanent residency.
